## Who Decides on Data Centers Near Detroit

DATA CENTER: NEWS, INFORMATION & RESOURCE CENTER FOR DETROIT

Wayne County now holds Michigan's largest approved data-center campus, and the decisions that got it there ran through a township planning commission, the county commission, and the state utility regulator.

A data center in or near Detroit would first need local land-use approval through City of Detroit, and Wayne County Commission and County Executive weighs in on land outside city limits and on tax incentives. The Michigan Public Service Commission is the state utility regulator; it reviews rates and large-customer power contracts for the utilities it oversees. Air and water permits come from the Michigan Department of Environment, Great Lakes, and Energy (EGLE).

**National context:** Federal energy researchers estimate data centers used about 4.4% of all U.S. electricity in 2023 and could use 6.7% to 12% by 2028, which is why utility commissions, local boards, and voters are now central to where these campuses land. ### What’s on file near Detroit

- **Van Buren Charter Township, Wayne County**Google's Project Cannoli, a 1-gigawatt data center campus on roughly 280 acres north of I-94 near Haggerty Road, received preliminary site plan approval from the township Planning Commission in February 2026 and final site plan approval in October. The township approved $125 million in tax incentives in May. On Oct. 1, 2026, the Wayne County Commission voted 13-0 to override County Executive Warren Evans's veto of the county tax incentive, and the Michigan Public Service Commission approved the DTE power contract with conditions meant to keep costs off other customers. Township officials say the campus could use 2 million to 3.6 million gallons of water a day at full operation.
- **Lyon Charter Township, Oakland County, next door to Novi**Project Flex, a proposed 1.8 million-square-foot, six-building data center on 172 industrially zoned acres near Milford Road south of Grand River Avenue, won conditional Planning Commission approval in September 2025. As neighbors organized, the township adopted a six-month moratorium on new data-center applications in March 2026 that does not cover Project Flex, and residents filed recall petitions against the Board of Trustees. The developer has offered about $10 million in township-administered community funds and filed a sixth site plan in October 2026, with Planning Commission review expected Nov. 9.
- **Augusta Charter Township, Washtenaw County**On Aug. 4, 2026, voters overturned Ordinance 2025-02, which had rezoned seven parcels totaling 522.2 acres from Agricultural Residential to General Industrial for a proposed hyperscale data center campus tied to Thor Equities. The result was 2,314 No (89.59%) to 269 Yes (10.41%), so the land stays agricultural residential. The Township Board had approved the rezoning 7-0 on July 22, 2025, and residents petitioned it onto the ballot. On Sept. 22, 2026, the board adopted Ordinance 2026-04, which lets the township impose temporary zoning moratoriums of six months to one year. A separate recall effort against all seven township officials cleared county petition review on Sept. 24; the earliest possible recall election would be May 2027.
- **Ohio spillover watch**On Nov. 3, 2026, Ohio voters in 18 municipalities decided 21 local data-center measures, more than half of the 41 on ballots nationwide, and every Ohio result went against new data-center development, from outright bans to voter-approval and financial-guarantee rules. With that many Ohio doors closing at once, developers hunting for power, land, and water are expected to look harder at southeast Michigan and the I-94 and I-96 corridors, which is why the decisions below matter here.

### The case for and against

#### The case for data centers

- **Negotiated protections and local revenue**Van Buren Township officials say tax incentives were the only lever to win berms, sound walls, and wildlife corridors their zoning ordinance could not require, and county commissioners argued the project will fund countywide work and help lower local water bills. [Official reference](https://www.vanburen-mi.org/)
- **Power contracts built to protect other customers**Regulators approved the Van Buren and Saline power contracts with conditions meant to keep costs off other DTE customers, including long-term minimum payments if a campus leaves early and developer-funded renewable energy and storage. [Official reference](https://www.michigan.gov/mpsc)

#### The case against

- **A rushed process**Wayne County's executive vetoed the county incentive, arguing the company pressed the county to act in about two weeks with too little time for public input or independent review. Commissioners overrode the veto 13-0, but the process complaint has not gone away. [Official reference](https://www.waynecounty.com/)
- **Water and grid scale**At full operation the Van Buren campus could use 2 million to 3.6 million gallons of water a day, and a single gigawatt of demand is on the scale of a large power plant. Critics want stricter township zoning and a closer look at new gas generation tied to data-center load. [Official reference](https://www.michigan.gov/egle)
