What is NIL?
Name, Image
& Likeness

NIL stands for Name, Image, and Likeness — an athlete’s right to earn compensation when a third party uses their name, image, or likeness (endorsements, social posts, appearances, camps, autographs). In Michigan, college NIL is governed by Mich. Comp. Laws § 390.1731 et seq.read the full statute. High-school NIL is permitted in Michigan under conditions set by the Michigan High School Athletic Association (MHSAA) (MHSAA Handbook, Regulation I — Section 11 (Personal Branding Activity / Name, Image, and Likeness)). What the Statute Says

College Athletes May:
  • Earn compensation for the use of their name, image, or likeness, independent of athletic participation or performance (MCL 390.1733).
  • Sign endorsement contracts and participate in advertising campaigns with third parties for the period of their eligibility; compensation does not affect scholarship eligibility or renewal (MCL 390.1733–1735).
  • Use a school’s trademarks or facilities in NIL activities only if the institution expressly grants permission; institutions are not required to facilitate NIL opportunities for students (MCL 390.1733).
  • Retain an agent, attorney, NIL advisor, or other representative to arrange and secure NIL deals; institutions may not prevent students from obtaining professional representation related to NIL contracts (MCL 390.1733).
Prohibited:
  • Endorsements for tobacco, alcohol, gambling (including sports betting), illegal substances or activities, or banned athletic substances (MCL 390.1735).
  • Apparel contracts that require the student-athlete to display a sponsor’s apparel during official team activities if those activities conflict with a provision of the student-athlete’s ‘team contract’ with the institution (MCL 390.1735).
  • Compensation for athletic participation or performance (pay-for-play) beyond what is permitted by institutional or collegiate athletic association policy, court order, or settlement (MCL 390.1733).

HIGH-SCHOOL NIL — Michigan High School Athletic Association (MHSAA) RULES
Conditions for HS Athletes

MHSAA Handbook, Regulation I — Section 11 (Personal Branding Activity / Name, Image, and Likeness)

Effective January 27, 2026, the MHSAA Representative Council unanimously adopted Regulation I, Section 11, permitting Michigan high school student-athletes to earn compensation through Personal Branding Activity (PBA) — the MHSAA’s term for NIL. Michigan became the 46th state to adopt high-school NIL provisions. Athletes may earn compensation from individual, third-party branding opportunities provided all activities comply with MHSAA rules.

Conditions:
  • Compensation must NOT be contingent on athletic performance, statistics, awards, team participation, or competition outcomes (pay for play is prohibited).
  • Compensation must NOT be an inducement to enroll at, remain enrolled at, or transfer to a specific school.
  • PBA must NOT be provided, facilitated, arranged, or promoted, directly or indirectly, by an MHSAA member school, coach, administrator, employee, or any associated entity or individual (including boosters who contributed over $10,000 in the past four years).
  • No MHSAA or member-school name, logos, mascots, trademarks, or other obvious identifiers (including uniforms, facilities, or school social media accounts) may be used.
  • No school apparel, uniforms, or equipment bearing school name, logo, or mascot may be worn in any PBA.
  • No member-school facility (stadium, gym, fields, or other school property) may be used for any PBA activity.
  • PBA may not involve industries deemed inappropriate or inconsistent with interscholastic athletics values, including gambling, gaming, betting, alcohol, tobacco, cannabis, banned substances, performance enhancers, firearms/weapons, or adult/explicit content.
  • Any verbal or written PBA opportunity or contract must be disclosed to the student-athlete’s school and to the MHSAA within seven (7) business days of finalization, via MHSAA’s required Disclosure Form, for review and approval before the contract is signed.
Penalties for Violations:
  • Student violation: minimum 90 school days of ineligibility from all MHSAA interscholastic athletics from the date of determination; maximum up to remaining eligibility.
  • School/staff violation: suspension of school employee or connected individual; member school may face loss of MHSAA membership privileges and removal from MHSAA tournament competition.
  • Third or repeated violations: penalty determined by MHSAA based on nature, knowledge, and intent of the violation.

NCAA NIL POLICY — APPLIES TO ALL DETROIT COLLEGE PROGRAMS
NCAA Name, Image, Likeness (NIL) — interim & ongoing policy

NCAA rules apply alongside state law; athletes should review both their campus NIL policy and applicable state law, and consult their compliance office or Faculty Athletics Representative (FAR).

NCAA Says Allowed:
  • Compensation specifically for use of the athlete's NIL (ads, posts, appearances).
  • Deals with a valid business purpose tied to a real product, service, or event offered to the public.
  • Compensation within a reasonable range for people with similar fame or influence.
  • Use of an agent or marketing professional for NIL services.
NCAA Says Not Allowed:
  • Pay with no required promotional activity or deliverables.
  • Agreements that say the athlete's NIL will be used later with no defined plan.
  • Pay-for-play, including payment to attend or compete for a specific school, or compensation for athletics participation or achievement.
  • Compensation outside a reasonable range for similar deals.
Disclosure (Division I):

Division I athletes must report all third-party NIL deals worth $600 or more (aggregate smaller payments from the same payer that total $600 or more) via NIL Go, the College Sports Commission's compliance-review platform.
